Dealing with questions arising out of the will of the late John Bastard, formerly postmaster at Port Adelaide, his Honor said questions had arisen in the administration of the estate in consequence of a judgment he had delivered on August 9, 1932. The summons had been amended by including the question - "with reference to the income of the estate arising during the age of 21 years by a grandchild of the testator, and the attaining of that age thereafter by another grandchild when, and whether in quarterly or half-yearly payments, or how otherwise should the trustee distribute such income and amongst whom?"
His Honor agreed with the answer submitted by counsel for the trustees - "that such income should not be distributed quarterly or half-yearly, but should be distributed when the second mentioned child attains the age of 21 years, between the children of the testator then living and the personal representatives of any children who might be then dead and had died after the testator." There were other questions which his Honor also answered in accordance with the construction placed on the matters by counsel for the trustees.

and Mr. A. M. Moulden for Adelaide Elizabeth Bastard (executor of Thomas D. Bastard).
