Reserved judgment was given in the Civil Court yesterday by Mr. Justice Richards, in the application arising out of the will of Mr. John Bastard, formerly postmaster at Port Adelaide. Mr. Bastard died in June, 1908, having executed a will in February, 1904. His estate is valued at about £5,000. Matters arising out of the will have been before the court on two previous occasions. His Honor said the main question now asked was whether certain directions in the will involving accumulation of income of the residuary estate during certain periods defined by previous orders were not void under the provisions of the Accumulation Act, 1800, and if so to what extent. The answer was. "Yes, as from the death of the testator's widow." The widow died in 1930.
At the hearing Mr. H. B. Piper appeared for the Executor Trustee and Agency Co (trustee),
Mr. G. C. Ligertwood. K.C., with Mr. K. C. Duffield for Mrs. Beatrice May Guenther (a daughter of the testator),
and Mr. K. L. Ward for F. J. Baxter (a beneficiary).
