Probate 1838


In the Name of God Amen

I Thomas Bebbington of Nantwich in the County of Chester Gentleman being of sound and disposing mind memory and understanding God be praised for the same do make and publish this my last Will and Testament in manner following that is to say first

I direct that all my just debts funeral and testamentary expenses shall be fully paid and discharged as soon as conveniently may be after my decease and

I give and bequeath unto my oldest son Ralph Bebbington of Manchester in the County of Lancaster joiner and Cabinet Maker one Guinea only he being otherwise provided for

and I give devise and bequeath unto my son John Bebbington of Nantwich aforesaid Butcher his heirs executors and administrators all that my Messuage or dwelling house wherein I now live with the yard garden buildings hereditaments and appurtenances thereto belonging situate lying and being in a certain Street in Nantwich aforesaid called the Chopper? Street and also all my household Goods and furniture plate linen china Glasses and ??? and implements of all sorts in upon & about my said Messuage or dwelling house and premises in Nantwich aforesaid and also all that my pew or Seat situate and being in the South Aisle of the Parish Church of Nantwich aforesaid and now in my ?? ?? and which I which I purchased many years ago from the late Mr James Cheney and my late Brother John Bebbington To have and to hold all that my said Messuage or dwelling house pew or Seat household goods and furniture plate linen china Glasses ?? and implements of all sorts to the use of my said son John Bebbington his heirs Executors and admors to and for his and their own use and benefit absolutely for ever? ?? occupied? and discharged from the payment of my debts funeral and testamentary expenses or any part thereof

And I give and devise all that my two messuages or dwelling houses with the Gardens hereditaments and appurtenances thereto belonging and also all those my two closes fields or parcels of Land or ground situate lying and being Willaston in the parish of Wybunbury in the said County of Chester and now in the several holdings of my said Son John Bebbington Thomas Featherstone Thomas Tomkinson and Thomas Birchall unto and to the use of my said Son John Bebbington and my Son Thomas Bebbington of Nantwich aforesaid butcher equally to be divided between them my said Sons John Bebbington & Thomas Bebbington share and share alike as tenants in common and not as joint tenants their respective heirs exors and admors absolutely for ever

And I also give devise and bequeath all the rest residue and remainder of my monies Stocks funds Goods Chattels real and personal Estate whatsoever and wheresoever and of what nature kind or quality soever unto and to the use of my said two sons John Bebbington and Thomas Bebbington equally to be divided between them share and share alike as tenants in common and not as joint tenants their respective heirs executors and admors absolutely for ever

and I hereby constitute? and appoint John Jasper Garnett and Richard Leversage the Younger both of Nantwich aforesaid Gentleman Executors of this my last will and testament hereby revoking and making void all former wills by me at time hereto fore made

In witness whereof I the said Thomas Bebbington the Testator have to this my last Will and Testament set my hand and affixed my Seal this fourth day of May in the year of our Lord one thousand eight hundred & twelve Thomas Bebbington Signed Sealed published and declared by the said Thomas Bebbington the testator as and for his last will and testament in the presence of us who at his request in his presence and in the ??? of each other have subscribed our names as Witnesses thereto

Proved at London 11th. August 1838 before the Judge by the Oath of Richard Leversage the younger one of the Executors to whom admon was granted having been fist sworn duly to adminr. power reserved of making the like grant to John Jasper Garnett the other Executor when he shall apply for the same.

Note in the border of the Probate

On the 9th. day of April 1839 Admon (with the will annexed) of the Goods Chattels & Credits of Thomas Bebbington late of Nantwich in the County of Chester Widower deceased left ?? by Richard Leversage the You decd. whilst living one of the Exors named in the said will was granted to Ralph Bebbington the lawful Grandson & one of the persons entitled in distribution to a moeity of the Personal Estate and Effects of the Said Deced undisposed of by the said Will having been first sworn duly to Administer John Jasper Garnett the Surviving executor named in the said Will having renounced the Probate & execution thereof and Thomas Bebbington the son one of the next of kin and one of the Residuary Legatees named in the said Will died in the lifetime of the said deceased & John Bebbington the son also, one other next of kin and the other Residuary Legatee named in the said Will survived the said deceased but is since dead.
