FOSTER v FOSTER.

The petitioner in this case was Annie Foster (formerly Hartley), who sought a divorce from George Henry Foster, a steward, on the ground of desertion for three years and upwards.

Mr. J. C. J. Ryan appeared in support of the petition, the suit being undefended.

The parties were married on May 29, 1901, at St. Benedict's Church according to the rites of the Roman Catholic Church.

His Honor said he at first entertained doubt on the question of domicile, the respondent being a native of Victoria. He granted a decree nisi, returnable in six months after service on the Crown Solicitor, petitioner to have custody of the children, respondent to pay the costs of the suit.
