I ALMA ALICE BYE of "Alming" No. 183 Commercial Road Staines in the County of Surrey (postal address Staines Middlesex) the Wife of IRVING THOMAS BYE HEREBY REVOKE all Wills and testamentary dispositions heretofore made by me AND DECLARE this to be my last Will.
1. PROVIDED that my said Husband Irving Thomas Bye survives me for a period of twenty eight days then I APPOINT my said Husband IRVIN THOMAS BYE sole EXECUTOR of this my Will AND SUBJECT to the payment of my funeral and testamentary expenses death duties and debts I GIVE DEVISE AND BEQUEATH all my estate both real and personal whatsoever and wheresoever situate including any property over which I may have any power of appointment for any interest whatsoever to my said Husband IRVIN THOMAS BYE absolutely.
2. In the event of my said Husband not surviving me for the period aforesaid then the following clauses of this my Will shall apply.
(a) I APPOINT BRYAN CORRIE and JOHN ARNOLD PITHER WILSON both of Coln Lodge Clarence Street Staines aforesaid Solicitors and also my Son COLIN THOMAS BYE if and when such Son shall attain the age of twenty one years to be the EXECUTORS AND TRUSTEES of this my Will and I DECLARE that the expression "my Trustees" used throughout this my Will shall (where the context permits) include the Trustees or Trustee for the time being of this my Will whether original or substituted
(b) I APPOINT HENRY CHARLES MILES and his Wife ALVIRA MILES of No. 181 Commercial Road Staines aforesaid to be the GUARDIANS of my infant Sons.
(c) I GIVE DEVISE AND BEQUEATH all my real and personal estate whatsoever and wheresoever situate not hereby or by any codicil hereto otherwise specifically disposed of and which I can dispose of by Will in any manner I think proper either as Beneficially entitled thereto or under any general power unto my Trustees UPON TRUST that my Trustees shall sell the said real estate including chattels real call in sell and convert into money such part of my personal estate as does not consist of money with power to postpone such sale and conversion for such a period as my Trustees without being liable to account and in their absolute discretion my think proper and so that any revisionary interest be not sold until it falls into possession unless my Trustee sees special reason for sale
(d) My Trustees shall out of the money to arise from the sale and conversion of my said real and personal estate and out of my ready money pay my funeral and testamentary expenses death duties and debts
(e) My Trustees shall stand possessed of the net proceeds of my estate UPON TRUST for such of them my two Sons COLIN THOMAS BYE and ALAN BYE as shall survive me and attain the age of 21 years and if more than one in equal shares absolutely.
(f) I DECLARE that monies liable to be invested under the trusts of this my Will may be invested in the purchase of real property or in or upon such stocks shares securities investments or other property of whatever nature and wheresoever including a freehold or leasehold dwellinghouse as a residence for any beneficiary as my Trustees shall in their absolute discretion think proper without regard to any rules of law or equity as to the investment of trust monies and with the like absolute power of varying such investments from time to time to the intent that my Trustees shall have the same full and unrestricted powers of investing and transposing investments in all respects as if they were absolutely entitled thereto
(g) In addition to all other powers conferred by law my Trustee shall have power at any time and from time to time raise capital and pay or apply the same to or for the benefit of my said children and whether or not they shall in so doing exhaust the capital of my residuary estate.
(h) ANY EXECUTOR or trustee for the time being hereof being a solicitor or other person engaged in any profession or business shall be entitled to charge and be paid (in priority to all other dispositions contained herein) all usual professional or other charges for business done by him or his firm in connexion with the proving hereof or the execution of the trusts hereof whether in the ordinary course of his profession or business or not and including business which an executor or trustee not being engaged in any profession or or business could have transacted personally.
