This is the last Will and Testament of me William Paddy of Christchurch in the Colony of New Zealand Gentleman
I appoint Nathaniel Philip Meyers of Christchurch Grainbroker and John Wesley Smith of Sydenham Painter to be the executors and trustees of this my will
I give devise and bequeath unto my trustees the whole of my household furniture and effects In trust for my wife Susan Paddy for her life and after her death then in trust for my daughter Maria Churcher Myers wife of the said Nathaniel Philip Meyers absolutely
I give and devise unto my Trustees all my real estate in trust for my wife Susan Paddy for her life and upon her deceased then in trust for my said daughter Maria Churcher Myers for her life subject to a charge of Forty pounds as hereinafter mentioned and on the death of my said daughter Maria Churcher Myers then in trust for the children of the Maria Churcher Myers the issue of her marriage with the said Nathaniel Philip Meyers in equal shares subject to the said charge of forty pounds
And I direct that when the youngest of the said children shall arrive at the age of eighteen years my trustees shall sell the said property and divide the proceeds of such sale amongst the said children in equal shares
And I also direct that after the death of the said Maria Churcher Myers and until the youngest child shall attain the age of eighteen years as aforesaid my trustees shall let the said said property and shall appropriate the rents and profits thereof towards the maintenance and education of such children in such manner as my trustees in their absolute discretion shall think fit
And I hereby declare that as I am desirous of leaving to my adopted daughter Mary Amelia Kurnode? the sum of forty pounds if she become a widow at any time such sum not to be paid to her until after the death of my wife I therefore direct my trustees upon the said Mary Amelia Kurnode? becoming a widow as aforesaid to raise the said sum of Forty pounds on a mortgage of the said property and to pay the said sum to the said Mary Amelia Kurnode?
And I direct that the said Maria Churcher Myers shall pay the interest of the said mortgage during her life and after her death the said sum shall be a charge upon the said land
I give devise and bequeath the whole of the residue of my estate to my trustees In trust for my daughter Helen Elizabeth Henderson wife of John Henderson Printer now residing in Sydney for her life and after her decease I direct my Trustees to hold the said property in trust for the children of the said Helen Elizabeth Henderson and upon the youngest of such children attaining the age of eighteen years I direct my trustees to sell call in and convert into money the whole of such residuary estate and divide the proceeds thereof among the children of the said Helen Elizabeth Henderson in equal shares
And I further direct that in meantime after the death of the said Helen Elizabeth Henderson and until the youngest of such children shall arrive at the age of eighteen years my Trustees shall devote the income and profits arising from the said residuary estate towards the maintenance and education of the said children of the said Helen Elizabeth Henderson in such manner as they in their absolute discretion shall think fit
And lastly hereby revoking all former wills and testamentary dispositions heretofore made by me I declare this to be my last Will and Testament
