Will of William Shepherd, 6 April 1730

I William Shepherd Junior of Bramham in the County of York Husbandman do make this my Last Will and Testament Revoking all other Wills or Deeds whatsoever

Jmpes or Impes [written in the margin - it may mean 'I am minded to' or 'It is my intention to', etc.]

I give and bequeath unto my beloved Wife Mary Shepherd all my Real and Personal Estate Lying in Bramham or Else where for Ever She giving my Children a proportionable Maintenance out of it, She discharging my Debts and funeral Expences I Nominate and appoint her my Sole Executrix of this my Last Will and Testament In Witness whereof I have hereunto Set my hand and - Seal the Sixth day of April 1730

NB - Mary was William Shepherd's 2nd wife, nee Pickherd, and he already had a few children by his 1st wife Elizabeth, nee Powell. At some stage, James Powell, presumably a relative of Elizabeth's, was also brought into the planned administration of William Shepherd's Will.

Know thee by these presents, that We Mary Shepherd of Bramham in the County of York Widow and James Powell of the same place Yeoman

are Bound, and firmly Obliged to the Worshipfull William Ward Doctor of Laws Commissary or Auditon of the Causes or businesses of the Venerable the Dean and Chapter of the Cathedral and Metropolitical Church of Saint Peter of York lawfully Authorized.

in the Sum of Ten Pounds of good and lawful Money of Great-Britain, to be paid to him the said William Ward certain Attorney Executors, Administrators or Assigns, For the Payment whereof well and truly to be made, We oblige ourselves, and Each of us, by ourselves, for the Whole and the Full our Heirs, Executors and Administrators firmly by these Presents. Sealed with our Seals Given the Eighteenth Day of the Month of May in the Year of our Lord One Thousand Seven Hundred and Forty Five

THE Condition of this Obligation is such, That if [inserted the above bound] Mary Shepherd Widow Relict and Sole Executrix of the last Will and Testament of William Shepherd late of Bramham in the County of York and within the Jurisdiction of the Dean and Chapter of York deceased do well and truly Execute and perform the said Will

And do pay his Debts and Legacies so far as his Goods will Extend and law shall bind her If also She - - do Exhibit into the Dean and Chapters Court at York - - a true and perfect Inventory of all and Singular the Goods, Rights, Credits, Cattels and Chattels of the said Deceased, and do make a True and Just Account of the same when She shall be thereunto lawfully called. And moreover, if Need require, enter into further Bond, with more sufficient Sureties for performance of the Premisses, as the JUDGE of the said Court for the Time being, shall think requisite and needful. And lastly, do save, defend, and harmless keep the abovenamed JUDGE, and all his Officers and Ministers against all Persons by reason of the Premisses. Then this present Obligation to be Void, and of none Effect, or else to remain in full Force and Virtue.
