DARWIN, Fri: Donald Speed, 37, of Bruce st, Toorak, and of Autoterms Ltd, Melbourne, was convicted in the Supreme Court today before Judge Wells of having stolen a quantity of valves, the property of the RAAF.
Allan Elliott Penrose, accountant, of the Waltham Trading Co, was found not guilty of stealing and receiving, and was discharged.
Mr Monahan, KC, counsel for Speed, submitted to his Honour that leave to appeal to the High Court would be sought on the grounds of jurisdiction submitted to this hearing, and suggested that his Honour might in the meantime remand Speed for sentence, as the High Court would rise today for one month.
Speed was remanded for sentence to the first week of the Supreme Court sitting late in July.
If leave to appeal is granted in the meantime, he will not need to appear for sentence until the question of the appeal has been decided.
Bail was fixed at £500, with one surety of a like amount.
His Honour indicated that the sentence would be substantial, and that Speed might wish to appeal against that.
