THE enforced sale of a large Richmond garage was delayed yesterday by an order made in Supreme Court chambers.
The sale, fixed by the Supreme Court sheriff for next Monday, will be delayed pending further Supreme Court litigation.
The garage - operated by Yarra Park Industries Pty. Ltd. and Yarra Park Investments Pty. Ltd. - is situated at the corner of Swan st. and Punt rd., Richmond.
The sheriff's sale of the company's assets was to be held to satisfy a Supreme Court judgment for £622 18 5.
Henry Herbert Dudley Ingram, of Barkly st., North Fitzroy, accountant, sought a stay of execution of the judgment.
He stated in an affidavit that he was owed a total of £2,066 in accounting and auditing fees by the companies, for which he acted as accountant and auditor.
Ingram said he had petitioned for the winding up of the companies.
He said that Donald Speed, a director of the companies, had told him, and he believed, that the companies were largely indebted to numerous creditors and were insolvent.
He believed that the companies' freehold assets, with improvements, were worth at least £50,000.
The Acting Chief Justice (Sir Charles Lowe) ordered that the execution of the Supreme Court judgment against the companies be stayed pending further legal action.
