The accused's
evidence.
I heard men talking in the paddock. Dyke & I went
there & saw 2 men. Dyke asked their names &
called to them to halt but they continued to walk
away & finaly broke into a run. We ran
after them & I overtook one man who turned
out to be Pte Haksins who struggled ??.
During the struggle he fell to the ground. I held him
there until Mr Dyke placed him under arrest
by Sergt Jones. I then went to my bed.

The room the 3 men were in is attached to the
farm house & liquor is only sold until 8 pm.
There is no bar trade.

I was orderly officer that day.

I told the men to go to bed & seeing they had been
drinking I tried to pacify them & get them off to
bed. I may have said something about shewing
them the way outside but I never offered to fight
or had any intention of doing so.

I was not drunk that night. I did not stagger
from intoxication at the barn.

Cross examined by the prosecutor:-

I did not offer to shake hands, but I did
shake hands with 2 of them. I only had one lot of
drink. I did this to pacify them
. I then went
out. I made no statment such as Private to
private. What I did say was "Its a good job
I am not a private or I would bundle you out" or
similar words. I did not unbutton or attempt
to remove my coat. I did not stagger at the
barn. I held Haskins down, I sat on him
on the ground.

I did not usually tell privates my short name
"Maysey". I do not consider it the usual conduct
