of an officer. I think it would be a good thing to
drink with the men if it would pacify them.

Although I was orderly officer I did not leave the
billet at 8 pm. or until 10 pm.

I had no drink at mess or during the day.
After dinner I had 2 very small drinks with
Mr Dyke. I had no more drink until I entered the
estaminet. I can suggest no reason why
the 3 men should ?? their story against me.
I was not the worse for liquor.

By the court:-

I am commissioned since February 1916. I had
not known any of these 3 men before. My orders
as to estaminets as orderly officer were that all
estaminets were to be open only from 6pm to 8pm.

I never had any orders in writing as to orderly officer's
duties - Not with regard to estaminets.

I enlisted in the AIF. on 14 Sept. 1915. as a private
& have had no previous soldiering.

His evidence is read to the accused. RP.83B is
complied. The accused withdraws from the place
from which he has given his evidence.

At 10pm on evening of 17th Anderson & I
came up to the billet where our Company mess is.
The place was in darkness, I looked in the window.
I could see figures inside & we went in.
