normal. He seemed angry. It was by speaking that
I saw he was excited. I did not take much notice.
I was in bed. I think the struggle on the ground would
have been sufficient to account for his exciteability.

His evidence is read to witness. R.P.83B is com-

is sworn & examined by accused's friend.

On Saturday evening 17th June I was in the
officers' mess billet at about 8.30 pm until 10 pm
speaking to Mr Dyke. The accused was there all
the time. When I left the accused was sober.
He did & said nothing to make me think he was other-
wise than sober.

Cross examined by the prosecutor:-

Just about 10 pm the light was blown out,
previously to that there had been a light in the
room.

Reexamined - Accused had no drink while I
was in the room.

By the court:-

I think accused was writing part of the time.
He also joined in the conversation. & was under my
observation.
