1st witness. Reexamined by prosecutor:-

At company orderly room when I said I
did not remember clearly I was refering to my
own charge. I don't know what the charge against
me was

By the court:-

The accused is in my battalion but is not
the officer of my platoon. Although he is in my company.

I had never spoken to the accused before that night.

His evidence is read over to the witness. Rule P.83B.
is complied with. The witness withdraws.

 
2nd witness. No. 3111 Corporal J.W. Nicholson 48th Bn. Sworn states in
in examination by the prosecutor:-

I remember Saturday evening 17th June 1916.

Ptes Haskins OShaugnesssy myself went into the
Estaminet. It was after 8pm but how much after
I don't know. Sometime under an hour after we
had entered - I should think it was more than ½ hour.
Mr Mayersbeth the accused came in to the Estaminet
& was invited to drink with us which he did.

After conversation Mr Mayersbeth's name was
discussed & he spelled it to us several times
then told us to call him "Maysie" for short.
After another drink accused shook hands & then
left.
After going away a minute or so
accused came back & asked who was the man
who squeezed his hand. Pte Haskins then said
it was he. & accused said he would meet
him - (Haskins) as private to private, & at the same time
he was undoing the top of his coat. I said to him
