"Don't be silly as you are an officer & he only a
private & we dont want to see any row here"
or similar words. And I put my hand on accused's
shoulder. I did this for no particular reason.

The accused then left & after taking a few
minutes longer in the doorway Mr Dyke came
out of his billet & ordered every body off to bed
or else it would mean a court martial. With that
I left for my billet - & Haskins left for the latrines.

Later I heard some shouting & I went out & found
Haskins on the ground & accused on top of him, &
Haskins on Sergt Jones' arrival was put in detention.
I went back to my billet & Pte. Pit(??) came & spoke
to me & just then the accused came up & told
us to go to bed or else we would be had up for
conspiracy, he said. Then I went to bed.

Accused was with us in the estaminet for part of an
hour. When accused came back to the estaminet
we were all standing near the door.

The accused, when he entered the estaminet, appeared
to me to have had a few drinks; and when he left I should
say accused was under the influence of drink.

Cross examined by accused's friend:-

I was not at all muddled that night. I had about
3 drinks in all. Accused may have been with us
more than five minutes, but I decline to say any time
at all on oath
. Accused never took his coat off.
I wont swear whether he undid it or not. He could
have done so if he had wanted. I think accused
had 2 drinks of wine while with us and no more.

I did not know the accused before. I judged
