that accused had had a few drinks when he entered
by his manner of speaking. His familiarity to us
was one thing which made me think he was rather
drunk.
His whole conduct was unusual in an officer.

Pte. Haskins appeared to me to be in possession of his senses
until he left & went to the latrine. He talked intellingently,
although he was rather excited when accused told him
he would meet him as private to private.

His evidence is read to witness, R.P.83B. complied
with. The witness withdraws.


3rd Witness No. 3115 Pte.V.O'Shaugnessy 48th Bn A.I.F. duly
sworn is examined by the prosecutor:-

On Saturday evening 17th June I was in an
estaminet with Corpl. Nicholson & Pte Haskins. We
went into the estaminet after 8pm but before 9pm I think.
We had not been very long there - perhaps ¼ hour - when
the accused came in. The accused spoke to us - we
talked & one of us asked him to have a drink. He had
a drink & we talked & asked him what his name was.
We could not get hold of his name & he spelled it for us
several times then told us to call him "Maysie" or
some such name. He appeared to be under
the influence of liquor. We all had another drink
& then accused shook hands with us & said goodnight
& left.
He returned almost at once & wanted to know
who was the man who had squeezed his hand.
Pte Haskins said that it was himself. Accused
then said "he would settle the matter with him
as private to private, & went to pull his coat off but
Corp Nicholson intervened & told him he was an
officer & not to cause a disturbance. Accused
