then left us & shortly after Mr Dyke came down &
ordered us to go to bed. Corp. Nicholson & I went up into
the loft & Haskins went towards the latrine.

Shortly afterwards we heard shouting & we came
down Nicholson & I & going out we found near
the door of the barn the accused sitting on Haskins
on the ground. I went back to my billet.

When the accused left the estaminet he seemed to
be under the influence of liquor. I judged this by his
manner of speaking & behaviour.

3rd Witness.
 
Cross examined by accused's friend:-

This was not an estaminet but a room in the billet in
which we had bought 4 bottles. I should
say accused was with us from a quarter to half an hour.
He had, I think, 2 drinks. It was white wine.

Accused unbuttoned his coat. I cant say how many
buttons he undid. I won't swear he undid any buttons.

I was with Haskins earlier on this evening. I was
quite sober. I was a little bit merry. Haskins
was fairly drunk. I saw Haskins when he was
in detention on the Sunday. I saw Corp Nicholson at
the door of the guard room then.

By the court:-

Accused had not been long with us. We could not
get the pronounciation of his name.

The lady of the house sells drink in the room in
which we eat. It's not marked up as an estaminet.

When I saw Haskins in the guard room on Sunday
I had no idea that any proceedings were being
taken against the present accused. I went to find
out why Haskins was here. Haskins never at
any time told me he was going to make a state-
