His evidence is read to witness. R.P.83B complied
with. The witness withdraws.

4th Witness. No. 3116 Pte J. Pitt 48th Bn AIF. is sworn &
examined by the prosecutor states:-

On Saturday night 17th June last I was awakened
from sleep in my billet by hearing shouting. I don't
know the time at all. I went out & saw the accused
near the barn & I asked him what the trouble
& received no reply. Accused was standing up in the open.
I then moved to the barn door & spoke to Corporal
Nicholson & while there the accused came up & told
us to get away to bed, or he would have us up for conspiracy.
The accused staggered & I caught hold
of him by the arm & he said "Let go my arm" which
I did. I then went back to my billet.

The accused was under the influence of liquor
that night. This was why he staggered I think.

XX. Cross Examined by the accused's friend:-

I saw accused walk up to me but it was only
for a few yards. I was standing alongside of accused
when he staggered. Accused did not fall down.
His order for me to go to bed was definite.
