Lieut. G.C.Dyke 48th Bn AIF. is sworn & examined
by the prosecutor states:-

On the evening of 17th June the accused was
to the best of my belief with me in the billet until
about 10pm. Mr Anderson & Mr Elliot came in
at 10pm & I went out of the billet. I returned at
about 10.15pm & found no one in the room. At
about 10.30pm the accused returned to the house &
very shortly afterwards I heard a disturbance out-
-side. I & the accused went out & found 2
men in the paddock behind some of the men's quarters.
I went up to these 2 men & the accused being present
I asked them what they were doing here. Receiving
no satisfactory reply I asked their names. They
refused to give their names & rond? off. I told
them to halt & they started to run. The accused
& I ran after them & the accused caught one of
the men & was holding him on the ground when
I came up. The man he held turned out to be
Pte Haskins & he appeared to be struggling. I
called for the Sergeants & placed Haskins in arrest.
Haskins was brought before his company commander
on Sunday morning charged with disobeying a lawful
command & resisting arrest & he pleaded guilty &
said either that he was drunk or that he could not
remember what he was doing. He was remanded
before his C.O. & the case was later dismissed.

The accused was in my opinion perfectly rational
& quite normal that evening.

Fifth witness.
Cross examined by accused's friend:-

The accused sprinted about 40-50 yards
after Haskins. That is one reason why I think
he was not drunk. We had ?? 3 corners,
the accused & I, & also the 2 men we were running after
